By downloading, installing, or using Legends of Ashwynd ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App. These Terms are a legal agreement between you and KingTech Labs LLC ("we," "us," or "our"), a Massachusetts limited liability company.
Your use of the App is also governed by Apple's Licensed Application End User License Agreement, available at apple.com/legal/internet-services/itunes/dev/stdeula/, which is incorporated herein by reference. In the event of a conflict between these Terms and Apple's EULA, Apple's EULA shall control with respect to your use of the App through the App Store.
This agreement is concluded solely between you and KingTech Labs LLC. Apple Inc. is not a party to these Terms and is not responsible for the App or its content. Apple has no obligation whatsoever to provide any maintenance or support services for the App. KingTech Labs LLC is solely responsible for the App and any claims you or any third party may have relating to it, including product liability claims, claims that the App fails to conform to applicable legal requirements, and consumer protection or privacy claims.
Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance, Apple will have the right to enforce these Terms against you as a third-party beneficiary.
Subject to your compliance with these Terms, KingTech Labs LLC grants you a limited, non-exclusive, non-transferable, revocable license to download and use the App on any Apple-branded device that you own or control, solely for your personal, non-commercial purposes.
All content, features, functionality, code, artwork, story text, game data, character designs, and trademarks within Legends of Ashwynd are the property of KingTech Labs LLC and are protected by applicable intellectual property laws. You may not sublicense, sell, resell, transfer, assign, or otherwise exploit the App or these rights.
Legends of Ashwynd is a single-player game. You may use the App for personal, non-commercial entertainment purposes only. You agree not to:
Legends of Ashwynd contains fictional characters, settings, and narrative content. All story elements, character names, locations, and events within the game are entirely fictional and are not intended to represent any real persons, places, or events.
The game includes fantasy combat, resource management, and strategic decision-making. All game content is designed for general audiences.
All game data, including save progress, hero information, inventory, and settings, is stored locally on your device. KingTech Labs LLC does not operate any servers that store, transmit, or process your game data. We do not have access to any information stored within the App on your device.
Because your game data is stored locally on your device, KingTech Labs LLC cannot recover your data if your device is lost, stolen, damaged, or reset, or if the App is deleted. You are solely responsible for your device and its contents.
The App may receive over-the-air updates through the Expo Updates framework to deliver bug fixes, balance adjustments, and content additions. These updates are downloaded automatically and do not collect or transmit any personal data. We may also release updates through the App Store from time to time. Some updates may be required for continued use of the App.
KingTech Labs LLC reserves the right to modify, rebalance, add, or remove game content, features, or functionality at any time, with or without notice, without liability to you or any third party.
The App does not include in-app purchases, subscriptions, or virtual currency transactions of any kind. All game content is included with the initial download at no additional cost.
The App is provided "as available." KingTech Labs LLC does not warrant that the App will be available at all times. The App may be unavailable due to maintenance, updates, third-party service outages (including Apple's App Store), or events outside our control.
In the event KingTech Labs LLC discontinues the App entirely, we will use commercially reasonable efforts to provide advance notice via an in-app notification or App Store listing update where possible.
To the fullest extent permitted by applicable law, KingTech Labs LLC's total cumulative liability arising out of or related to these Terms or the App shall not exceed the amounts paid by you for the App in the twelve (12) months immediately preceding the claim, or fifty dollars ($50.00), whichever is greater.
Some jurisdictions do not allow the exclusion or limitation of certain warranties or liability. To the extent such limitations are not permitted in your jurisdiction, KingTech Labs LLC's liability shall be limited to the maximum extent permitted by applicable law.
You agree to indemnify, defend, and hold harmless KingTech Labs LLC, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with: (a) your access to or use of the App in violation of these Terms; (b) your violation of any applicable law or regulation; or (c) your infringement of any intellectual property or other rights of any third party. This indemnification obligation survives termination of these Terms.
You represent and warrant that you are not located in a country that is subject to a U.S. government embargo or that has been designated by the U.S. government as a "terrorist supporting" country, and that you are not listed on any U.S. government list of prohibited or restricted parties.
Step 1: Informal Resolution. Before filing any formal claim, you agree to contact us at [email protected] describing the dispute and your desired resolution. Both parties agree to attempt good-faith resolution for 30 days before pursuing formal proceedings.
Step 2: Small Claims Court. If informal resolution fails, either party may bring an individual claim in small claims court in your county of residence or in Massachusetts, provided the claim qualifies under the court's jurisdictional limits.
Step 3: Binding Arbitration. Any dispute not resolved through Steps 1 or 2 shall be resolved through binding arbitration administered by JAMS under its Streamlined Arbitration Rules. The arbitration shall be conducted remotely unless otherwise agreed. KingTech Labs LLC will pay all JAMS filing and arbitration fees beyond the first $250 paid by you. The arbitrator may award the same remedies available in a court of law.
Class Action Waiver. YOU AND KINGTECH LABS LLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS OR REPRESENTATIVE PROCEEDING.
Arbitration Opt-Out. You may opt out of the arbitration agreement within 30 days of first accepting these Terms by emailing [email protected] with the subject line "Arbitration Opt-Out." Opting out does not affect any other provision of these Terms.
These Terms are governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, without regard to its conflict of law principles, except to the extent preempted by federal law. Subject to the arbitration agreement above, any disputes not subject to arbitration shall be resolved exclusively in the state or federal courts located in Massachusetts.
KingTech Labs LLC shall not be liable for any delay or failure in performance resulting from causes beyond our reasonable control, including without limitation acts of God, internet or telecommunications outages, actions of third-party platforms (including Apple's App Store), natural disasters, or government actions.
KingTech Labs LLC reserves the right to update these Terms at any time. We will update the "Last Updated" date at the top of this page when changes are made. For material changes, we will make reasonable efforts to provide notice via an in-app notification. Continued use of the App after any changes constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the App.
KingTech Labs LLC may suspend or terminate your access to the App at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, third parties, or the integrity of the App. Upon termination, your license to use the App ceases immediately. Sections 6, 10, 11, 12, 14, and 15 survive termination.
These Terms, together with our Privacy Policy and Apple's Licensed Application End User License Agreement, constitute the entire agreement between you and KingTech Labs LLC with respect to the App and supersede all prior agreements and understandings. If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
